Agreement Disclaimer

Please read this disclaimer carefully before creating or signing any agreement on PayToowe. By proceeding, you confirm that you understand and agree to the following.

1. PayToowe Is Not a Party to Your Agreement

Every loan agreement on PayToowe is solely between you and the other user named in it. PayToowe is a software tool; we do not lend money, borrow money, guarantee performance, or assume any obligation under your agreement.

2. Not a Lender, Bank, or Financial Institution

PayToowe is not a lender, bank, credit union, money transmitter, or licensed financial institution. We do not issue credit or extend loans.

3. Not Legal, Tax, or Financial Advice

Templates, suggested terms, and informational content on PayToowe are provided for general informational purposes only. They are not legal, tax, accounting, or financial advice. The enforceability of any loan agreement depends on your jurisdiction and your circumstances. Consult a qualified professional before relying on any agreement.

4. No Guarantee of Repayment or Enforceability

We do not guarantee that the other party will repay, that signatures will be honored by a court, or that any specific term is enforceable in your jurisdiction. Use of PayToowe does not insure or otherwise protect you against default.

5. You Verify the Other Party

PayToowe does not verify the identity, financial standing, or trustworthiness of users. You are solely responsible for confirming who you are transacting with. Trust Scores and verification badges are informational only — they are not endorsements or guarantees.

6. No Debt Collection

PayToowe does not collect debts on behalf of users. Automated reminders are courtesy notifications, not collection demands, and are not regulated as debt-collection activity under the Fair Debt Collection Practices Act or analogous laws.

7. Payment Facilitation

When you elect to send or receive money through PayToowe, transactions are processed by Stripe, Inc. Stripe is the regulated payment service provider for those transactions and its terms apply. PayToowe is not responsible for chargebacks, payment failures, or bank-level holds.

8. Electronic Signature

Clicking "Create agreement", "Accept", "Sign", or similar action is your electronic signature and signifies your intent to be legally bound by the agreement and by PayToowe's Terms of Service. You may print or download a PDF copy from the agreement page.

9. Disputes Between Users

PayToowe is not a court, arbitrator, or mediator. We will not resolve disputes between you and another user. You are responsible for pursuing or defending any claim through your own legal counsel and the appropriate forum.

10. Acknowledgement

By checking the acknowledgement box and proceeding, you confirm that you have read, understood, and agreed to this Disclaimer, the Terms of Service, and the Privacy Policy, and that you are entering into the agreement of your own free will.
